1. General
This User Agreement governs the relationship between the Administration of the AnyTanks website — 42APPS LLP (Almaty, Republic of Kazakhstan, BIN 230340016737) — and the User. Use of the Site constitutes acceptance of the terms of this Agreement.
2. Definitions
Transaction — the transfer of access to a game account between Users, carried out using the functionality of the Site.
User balance — an internal account on the Site used to pay for transactions and services within the platform. Withdrawal of funds from this balance is not provided.
Sales balance (Seller's) — a separate internal account to which funds from the Seller's completed transactions are credited and from which withdrawal is possible under the procedure described in the "Seller's Withdrawal of Funds" section.
Listing — an offer to sell a game account posted by a Seller-User on the Site that has passed moderation by the Administration.
Escrow — the Site's freezing of funds paid by the Buyer until receipt of the item is confirmed or the transaction is completed automatically.
3. Status of the Administration
The Site is an information and technical platform. The Administration is not a seller of accounts and bears no responsibility for their origin, content, or functionality after the completion of a transaction between the Seller-User and the Buyer-User.
The Seller guarantees the lawful origin of the account and is liable to rightsholders and third parties for any claims related to the violation of rights to the account or its use prior to the transfer.
The Buyer assumes the risk of subsequent access restrictions or blocking of the account related to the rightsholder's policy, their own in-game activity, or the game's security systems after the completion of the transaction, except for violations arising through the fault of the Seller during the warranty period.
4. Registration
Upon registration, the User provides a valid email address. The User confirms that they have reached the age of 16. All actions performed using the account credentials are deemed to have been performed by the User themselves.
5. Warranties and Refunds
The Administration provides a guarantee of successful access to the purchased account within 24 hours from the moment the data is transferred. If any problems are discovered within the warranty period, the User must contact support: https://t.me/anytanks_support. After the warranty period expires, the Administration's responsibility ceases, unless otherwise established additionally.
The warranty does not apply to accounts in the "Password change" category.
The Administration has no technical means to determine who changed the data — the User, the Seller, or third parties.
If the password is changed, the warranty is deemed void, and claims regarding such accounts are not considered.
Abuse of warranty procedures
Reports of an account malfunction submitted before the actual transfer of data or before the first login attempt are not considered.
If attempts to abuse the warranty are detected (false complaints, distortion of evidence, an attempt to obtain a refund without grounds), the Administration has the right to:- refuse to satisfy the claim;
- block the User's account;
- cancel the transaction without a refund.
6. Payment Procedure
The balance is topped up through the payment services available on the Site. The Administration does not store the details of payment instruments and is not responsible for the operation of payment systems. Withdrawal from the User's internal balance used to pay for purchases is not provided. Withdrawal is possible only from the Seller's sales balance under the procedure set out in the "Seller's Withdrawal of Funds" section.
7. Prohibited Actions
It is prohibited to post offers that infringe the rights of third parties; to use the platform for fraud; or to disrupt the operation of the Site. In the event of a violation, the Administration has the right to restrict the User's access to the Site and delete the information they have posted.
8. Intellectual Property
All materials of the Site are protected by copyright. The Site is not affiliated with game developers and does not assert the origin of the content posted by Users.
9. Limitation of Liability
The maximum liability of the Administration is limited to the amount of payment received from the User for the relevant transaction. The Administration is not liable for indirect damages.
10. Changes to the Agreement
The Administration has the right to make changes. The new version takes effect after publication.
11. Additional Provisions on Liability
The AnyTanks.com website, including the Administration, acts as an information intermediary within the meaning of Art. 1253.1 of the Civil Code of the Russian Federation and provides users with access to digital goods (accounts) posted on the platform.
The Administration is not the rightsholder of the accounts and bears no responsibility for their origin, the legality of their use, or possible actions by the game rightsholders.
The User accepts that access to an account may be restricted or terminated by the rightsholder for reasons beyond the Administration's control. In such cases, the Administration bears no responsibility and no refund is made, unless expressly provided otherwise by this Agreement.
The Administration has the right to suspend access if violations of this Agreement or suspicious activity are detected.
12. User Listings and Moderation
A Seller-User may post listings for the sale of game accounts on the Site through the relevant functionality. Each listing undergoes review (moderation) by the Administration and becomes available for purchase only after approval.
The Seller must provide accurate information about the account (characteristics, region, presence or absence of bindings, data for transfer) and guarantees lawful ownership of the account and the right to dispose of it. The Seller is responsible for the accuracy of the listing.
The Administration has the right to reject, remove, hide, or edit a listing, including in cases of inaccurate data, violation of this Agreement, or infringement of third-party rights. Where possible, a rejection is accompanied by a reason.
It is prohibited to post:- accounts obtained unlawfully or over which the Seller has no right of disposal;
- accounts encumbered by obligations to third parties;
- knowingly false listings, duplicates, and listings created with intent to defraud;
- offers that infringe rightsholders' rights or applicable law.
The Site's commission for a transaction is withheld from the amount due to the Seller in the amount displayed in the interface at the time of the transaction.
13. Transaction Procedure Between Users (Escrow) and Seller's Warranty
When an account is purchased from a Seller, the funds paid by the Buyer are frozen by the Site (escrow) and are not transferred to the Seller immediately. A transaction chat is opened between the Buyer and the Seller.
The Seller must transfer the account data to the Buyer via the transaction chat. The Buyer must check the account and confirm receipt (the "Item received" action) or open a dispute within 7 (seven) days from the moment the data is transferred.
If the Buyer does not confirm receipt and does not open a dispute within this period, the transaction is completed automatically, and the funds, less the commission, are credited to the Seller's sales balance.
The warranty period for a specific listing is set by the Seller and displayed on the item card. During the warranty period, the Buyer may open a dispute upon discovering a discrepancy between the account and its description or a loss of access through the Seller's fault.
The warranty does not cover access restrictions arising after the transfer through the Buyer's fault, due to a change of data by the Buyer or third parties, or due to the game rightsholder's policy or the Buyer's own in-game activity.
14. Dispute Resolution for Transactions
A transaction dispute is reviewed by the Site's support team. While it is being reviewed, the funds remain frozen. Following the review, support may complete the transaction in the Seller's favour or issue a refund to the Buyer's internal balance.
The parties must conduct all communication regarding the transaction in the transaction chat on the Site and must not move to third-party messengers. Evidence and arrangements obtained outside the Site may not be accepted when a dispute is considered.
15. Seller's Withdrawal of Funds
Funds received by the Seller from completed transactions are credited to a separate sales balance. The Seller may submit a request to withdraw these funds by a method available in the interface (for example, SBP or to a bank card) once the minimum withdrawal amount specified in the interface is reached.
A withdrawal request is reviewed and approved by the Administration. The Administration has the right to request additional verification, suspend, or reject a withdrawal in case of suspected rule violations or fraud, as well as until the review of the Seller's disputed transactions is complete.
Withdrawal of the Buyer's funds from the internal balance used to pay for purchases is not provided.
16. Grounds for Blocking and Freezing Funds
The Administration has the right to restrict access, block an account, remove listings, and freeze a User's funds, in particular in the event of:- violation of this Agreement;
- fraud or an attempt to deceive other Users or the Site;
- abuse of warranty procedures or the dispute mechanism;
- transfer of knowingly inaccurate account data;
- actions that harm other Users, the Site, or its reputation.
When blocking for a violation, the Administration has the right to cancel the relevant transactions, refuse withdrawal of funds, and withhold funds pending clarification of the circumstances to the extent permitted by law.
